I was talking to a friend the other day regarding this subject as you often see horses at the sales saying for sale to settle a livery account.
I just wondered if anyone had had to resort to these measures or if anyone had successfully taken a livery to court to recoup losses.
This is purely for discussion I do not own a livery yard and pay my own bill one month in advance!!! Lol
I've also posted it in the guest area so people can post nano impishly for obvious reasons.
It was more the court cases we were wondering about.

Really?? That should have said anonymously!!!! Phillipa, I think this new term should come into regular usage on HG, eventually it could gain entrance to the OED! I would imagine more than people realise as it would have to go through the claims court. It may seem hard but if a person cannot settle their equine's bills then this is the best solution as it rids the person of the liability. Harsh I know , but people really must think hard before taking on , it is not the buying but the long term costs of having a horse.

I got my 14hh whp through livery bill settlement We paid the bill we got the pony in theory as the cost of pony was the bill

We own a livery yard and you cannot sell a pony to settle a livery bill unless it states so in your contract you have with livery owners. The owner can sign a pony over to you in order for you to sell and settle the livery bill, but you can't say for example, I am owed £1500 therefore I am going to sell your pony to recoup fees (unless you have this sated in a contract with both parties)

I know someone on a yard I was on once got into financial difficulty he helped her out let her horse live out for cheaper as they was no charges for livery everyday then only until back on feet, offered her jobs around the yard to take some money off the bill but never suggested to sell the horse to pay off the bill but we didn't have a contract on the yard only rules which didn't mention that. In the end turned she turned sour and had told a few people she was going to move off at night so he then had the horse stabled and padlocked him in at night and took her tack at night too. She paid up in the end then moved off. I don't like that he was locked in incase of a fire but they was no changing his mind.

I have had to padlock a pony in his stable to get the owner to settle his bill, several hundred pounds. I should add that I lived on the premises and would therefore know if the pony was in trouble, the responsibility was with the pony's owner.

I just wonder when people who don't pay their livery bills will learn to accept that it is their responsibility as the animals owner to cover ALL costs incurred by them, I am sick to death of hearing how they fell on hard times etc etc etc...... said so much these days that it's like the boy who cried wolf - it means nothing these days in other words - then suddenly when a YO takes often desperate measures to recover what they are owed, they are suddenly the bad guy!!! These people need to face up to the consequences of their actions and stop expecting everyone else to pay to keep their horse. Sorry if this sounds harsh, but it happens too many times nowadays to always be a genuine case of hardship and not a case of the horse just being a status symbol for yet another idiot who hasn't got a clue how much these animals actually cost to keep both financially, emotionally and time wise too. Far too many buying horses cheaply due to economic climate, who know nothing about them and who shouldn't even have a goldfish let alone a horse or pony. Sorry folks but this really does annoy me, having seen the same things happen so many times on not only my yard but many others too. Just take responsibility or sell the animal if you can't afford it's keep, it would be for the best all round.
