Well, just when i thought id found the perfect buyer and home.. i let yorkie go on trial with buyer for two weeks left half deposit, very happy with pony keeping intouch letting me know how he is. Today, i find out her car failed its mot so she can't pay the full remaining balance... what ?! she can pay so much, as she needs car more than pony and its going to be sooo long before she can afford rest and doesnt want to wait that long for passposrt. When does it ever end ! I'm quite frankly angered by this when it was all agreed unless pony deemed unsuitable (which he is not ) Doh ! Must get MUG tattoed across forehead

The trouble is he is in good hands she put him on livery at tm showing yard and i really thought she wasnt going to do anything like this, it is pulling me to accept because he is in such a good home, but it is going back on what was agreed arrgh

I would take the pony back and keep the deposit she has left due to her going back on the agreement. I know things come up and it is unfortunate but what if she needed the vet and couldn't afford that? Just to add why is she waiting for the passport? it should have gone with the pony

It was part of trial agreement i said i would send as soon as payment cleared, It has crossed my mind as she has gone back on agreement.

i had this problem recently with a woman buying my mare, she would only text with bad news and in the end we took her back after 8 months of not even half the payment!

legally the passport has to go with the pony, you just don't sign the change of ownership forms untill full payment is received. I would also think (depending on the wording of your agreement) you are legally entitled to keep what she has paid for the pony

Legal or not there is no way the passport would be going out of my possession until the full amount had been paid! Some people just can not be trusted simple as! I have a mare on a breeding loan but the owners have kept her passport which is fine by me and I also once put one of my mares on loan which turned out to be a nightmare, the mare was neglected and I had all on getting her tack back never mind the passport!

Three options,
1. Take the pony back 2. Take whatever money she has to pay and that's that. 3. Tell her you want the outstanding balance by the date agreed or you will pick him up.
I would not give the deposit back, I would have thought tm's yard is not the cheapest yard around as it is a producers so is he on full livery? I would have thought there would have been funds available if that is the case. Whatever you decide you must stick to it and not let it drag out for yours and the ponies sake! Let's face it you weren't asking huge amounts for him in the first place! And on the passport issue I would just speak to the fell society and ask what to do. Good luck and let us know how you go :-)

rebel99, thats the conclusion i came to as he is on full livery being ridden ect.. I have stated that balance be paid by end of month, so will see what happens

I can understand where you are coming from Lisadundee totally BUT if there was to be an accident/illness etc and that horse had to be transported to the vets the passport has to be with it. Having a passport isn't proof of ownership anyway, anyone can get a general passport, but for a breed society passport you would have to have the change of ownership forms signed

We never gave her the passport, after we took her back we were having so much grief, threatening my horses, my house, all sorts we gave her the money back even though it was non refundable, after than we had a text say we owed her for all costs she incurred whilst having my mare! Cheeky!

Jesus laraapril i can't belive the cheek of some people! this is why his passport is with me as trial was a two week one for which i was expecting full payment to be made within this time period.
I hear where your coming from re- that he could have an injury ect.. but believe me if that were the case id be there with passport still in my hands at any hour, but he left in good health and it can be risky re if anything went wrong, but id rather make sure i had his documentation for my own peace of mind, if id have known it was going to be longer i wouldn't have let him be trialed in the first place.

Having a passport isn't proof of ownership anyway, anyone can get a general passport, but for a breed society passport you would have to have the change of ownership forms signed I have never once been asked for any of my horses passports by the vet and three of them have had operations over the last three years, a passport is not proof of ownership but a breed society passport makes the horse worth more should it be resold and I admit when I have rescued ponies from the meat man ot bought from auctions and they have come with breed society passports and there has been no way to trace the previous owners and they have not signed the passports to confirm a change of ownership, many times I have made up a signature and sent the passport off and it has come back registered in my name and never once queried!!! and sadly that's how easy it is!!! The only time I have ever been asked to have my horses passport seen is at the bigger county shows and some shows a proven vaccination record must be shown!

In fact the only time I have even been asked to see a passport is when one one of the horses has been PTS and then the horse can not be taken away without a passport, we have a busy livery yard and I can honestly say the same for everyone on our yard, none of us have ever been asked for our passports to be seen at the vets and one of my section D's has been up there a lot recently and stayed for weeks at a time!

I agree with you Lisadundee I too have never been asked to show my horses passports, not to vets not at shows, even when I lost 2 they never asked to see the passports.

It used to be that if you were stopped and asked for your passport and you didn't have it with you, you had a specified amount of time to produce it , I think it used to be about 3 hours though to be honest this could have changed I think we all agree that the passport system doesn't work particularly well

just noticed your update melrob26, glad its sorted out. I only mentioned the passport as someone enquired about a LWVTB on my horse so I contacted the arab horse society to find out what I had to do regarding his passport and they stated the pp had to go with him but I had to informed them that he was only on loan and to fill in the change of ownership form when he was paid for (I decided against it)

Melrob26 I'm so glad, it justs sounds like she was trying it on, glad you have stuck to your guns. I agree I would never want to go through selling again! I found it horrendous and very stressful and traumatic and I sold to the first person that came to view so I was lucky! Laraapril I suggest now you have deleted your membership you shouldn't post as a guest about people being cheeky and out of order when you have just been outed for stealing other peoples pics of their horses and passing them off as your own!!!!! Sorry mods but had to say something!
