with regards to the passport, say you are transporting a horse witout it's passport. Your car/ lorry breaks down and you have to be recovered. No professional transporter will transport your horse anywhere witout it's passport.

Ooo I really hope it works out for you Not wanting to add fuel to the fire here BUT...... I doubt very much a loan agreement agreed between two normal people would be classed a legally binding, it's my understanding that it would just be a civil matter. And I agree with BOW about the passport.... My vet always asks for mine and stamps them as a vaccination card too.

Just to be pedantic - an agreement between two individuals IS legally binding, but it will be a civil as opposed to a criminal matter if it goes wrong.

Luckily all sorted now and p'port on its way to new owner, but.. there should be something in place like an extra form so that if a horse/pony leaves owner on loan/share/trial then they could go on trial or loan if you get what i mean, so that rightful owner keeps passport so that it may stop people selling them on ect.. theres so many horses out there with no passports or perhaps not even the correct passports, its scary. although i'm sure there will always be problems with the system. But, i werent letting my passport go while he was on trial for my own peace of mind really.

When my Sec A went on loan, I informed the WPCS and they put a note on her records, so if the loanee tried to sell her on, it would be flagged up when the passport was returned for change of ownership, and they would also contact me in the meantime.

Just a word of warning - some people we knew were pulled over whilst travelling horses and didn't have their passports with them. It was a pretty hefty fine! It would appear it is taken quite seriously (I think the fine was about £1000).

I think you can actually get fined up to £5000. We always use to take my passport everywhere but never once got asked for it. My vet stamps it when he has his jabs but apart from that he never asks for it but he does know I have signed the section about going for meat as if this is not signed everything a pony is administered should be recorded. I personally think the whole passport thing is a farce and was just another way of making money! Good idea but it just isn't followed through properly!! Glad it is sorted now melrob :-)

can you carry a copy of passport, it showing the registration details and the markings? i don't always carry my ponies passports with me!

Once bitten twice shy with excepting payment in installments, which is a shame as im actualy buying a miniature mare this way, i dont have her passport which is fine, may be this lady was genuine and has borrowed the money?? Id never ever do it again though!!!

She has actually paid for him now, and i think she was just trying to get him cheaper ( if he wasn't cheap enough ) they had him a couple of weeks and has been out showing twice now coming 2nd each time. She has p'port now, i don't believe it was a genuine reason at all as she has a few horses to keep plus where my pony was being kept. I will never believe any excuses in future and will not accept instalments. I hope i never have to sell again, i couldn't believe how people could be especially when you are being honest about everything.
